These Terms of Service ("Terms") govern your access to and use of the Lapseleap website and application located at https://lapseleap.com ("Service"), operated by Bracino oü (Estonian registry code: 12452492) ("we", "us", "our"), a company registered under the laws of the Republic of Estonia.
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
Lapseleap is a browser-based time-lapse creation tool that allows users to capture webcam images, upload them to cloud storage, and generate time-lapse videos or animated GIFs. The Service is provided on a "Free" and paid "Pro" tier basis.
You must be at least 16 years of age to use the Service, in accordance with the Estonian Electronic Communications Act and the EU General Data Protection Regulation (GDPR). If you are under 18 years of age, you confirm that you have the consent of a parent or legal guardian.
To access certain features you must create an account using an email address and password or via Google OAuth sign-in. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
You agree to provide accurate, current, and complete information during registration and to update it as necessary.
The Service offers two tiers:
All payments for the Pro subscription are processed by Paddle.com Market Limited ("Paddle"), which acts as our Merchant of Record. Paddle is the entity that sells the subscription to you, processes your payment, handles applicable taxes (VAT, GST, sales tax), and issues invoices on our behalf.
By subscribing to Pro, you agree to Paddle's Terms of Use and Privacy Policy in addition to these Terms.
Usage-based overage charges (for images exceeding the monthly included amount) are metered by us and billed in arrears through Paddle on your next invoice.
Pro subscriptions renew automatically at the end of each billing period (monthly or annually) unless you cancel before the renewal date. You may cancel at any time through your Settings page or by contacting us. Cancellation takes effect at the end of the current billing period — you retain Pro access until then.
Please see our Refund Policy for details on cancellations and refunds. As Paddle is our Merchant of Record, refund requests are processed by Paddle.
You agree not to:
Our content: The Service, its design, code, logos, and branding are the property of Bracino oü and are protected under Estonian copyright law (Copyright Act, RT I, 1992, 49, 615) and international treaties.
Your content: You retain full ownership of all images, videos, and GIFs you create using the Service. By uploading content, you grant us a limited licence to store and process your content solely for the purpose of providing the Service. We do not claim any ownership of your content.
Images and generated media are stored in Amazon S3 in the EU (eu-west-1, Ireland). Content is automatically deleted after the retention period for your tier (7 days for Free, 30 days for Pro). You may delete your content at any time via the Settings page.
Upon account deletion, all associated data (images, videos, session records) is permanently removed within 30 days.
To the maximum extent permitted by the Estonian Law of Obligations Act (VÕS) and applicable EU consumer law:
Nothing in these Terms limits liability for death, personal injury caused by negligence, fraud, or any other liability that cannot be excluded under mandatory Estonian or EU law.
We strive to keep the Service available but do not guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue any part of the Service with reasonable notice. Material changes affecting paid subscribers will be communicated at least 30 days in advance.
We may suspend or terminate your account if you violate these Terms. Upon termination, your right to use the Service ceases immediately. Provisions relating to intellectual property, limitation of liability, and governing law survive termination.
We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting a prominent notice on the Service at least 14 days before the changes take effect. Continued use of the Service after changes constitutes acceptance of the updated Terms.
These Terms are governed by and construed in accordance with the laws of the Republic of Estonia, without regard to its conflict-of-law provisions.
In the event of a dispute, you agree to first attempt resolution through good-faith negotiation. If a dispute cannot be resolved amicably within 30 days, it shall be submitted to the Estonian Consumer Disputes Committee (Tarbijakaebuste komisjon) for mediation or, failing that, to the courts of Harju County, Estonia.
As a consumer in the EU, you also have the right to submit complaints through the EU Online Dispute Resolution platform.
